These Terms apply to all users of the Service, including but not limited to users who are contributors of content, information, and other materials or services.

2. Description of Service

evergreen. is a document assembly platform that enables users to create, manage, and publish documents using reusable content blocks. The Service includes:

• Document creation and management tools
• Reusable block library for content assembly
• Multi-language translation capabilities
• Version control and publishing features
• Public document sharing
• API access for programmatic document retrieval

3. User Accounts and Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

This license terminates when you delete your User Content or close your account, except for content that has been shared publicly or with other users.

You are responsible for:

• Ensuring you have necessary rights to all User Content
• Maintaining backups of your User Content
• Compliance with all applicable laws regarding your User Content

5. Intellectual Property Rights

The Service, including its original content, features, and functionality, is owned by evergreen. and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You may not:

• Reverse engineer or attempt to extract source code
• Remove or alter any copyright, trademark, or proprietary notices

SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on or through the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL EVERGREEN.'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID EVERGREEN. IN THE PAST TWELVE MONTHS FOR THE SERVICE.

8. Indemnification

You agree to indemnify, defend, and hold harmless evergreen., its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content or use of the Service
• Any activity under your account, whether or not authorized by you

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us at support@evergreendocs.app.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which evergreen. operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.
